Terms of Use
Version 2026-10-25 · Last updated October 24, 2026
These Terms of Use (the "Terms") govern your use of the website e-airbags.com and the services offered on it (together, the "Marketplace"), operated by [legal entity name — to be completed before launch] ("e-airbags.com", "we", "us"). By using the Marketplace you agree to these Terms. If you sell on the Marketplace, the Seller Agreement also applies to you.
1. About these terms
These Terms, the Privacy Policy, the Prohibited Items Policy, the Marketplace Disclosure and, for sellers, the Seller Agreement, form the entire agreement between you and e-airbags.com about the Marketplace. The help pages explain how the Marketplace works in plain language; if a help page and these Terms differ, these Terms control.
2. e-airbags.com is a marketplace
e-airbags.com is a marketplace. We do not sell airbags or any other part listed on this site. Every sale is a transaction between the registered seller named on the listing and the buyer; e-airbags.com processes the payment, holds it until delivery is confirmed, and provides buyer protection. The seller issues the invoice for every sale, which identifies the donor vehicle's VIN.
e-airbags.com is not a party to any sale between a buyer and a seller. We do not own, hold, inspect, test, certify or warrant any part listed on the Marketplace. Each listing is created by the seller named on it, and the seller alone is responsible for the accuracy of the listing, the condition and legality of the part, and the fulfillment of the order. Our role is to operate the platform, verify that sellers are commercial automotive businesses, require a donor VIN and a proof-of-origin document on every part listing, process and hold payments as described in Section 5, set shipping rules, and decide cases under Section 7.
3. Accounts
You must be at least 18 years old and able to form a binding contract to use the Marketplace. You sign in with a one-time code sent to your email address or through a supported identity provider; you are responsible for keeping access to that email address secure and for everything done under your account. Provide accurate information and keep it current. Selling requires a separate seller account approved by us under the Seller Agreement; seller accounts are available to commercial automotive businesses only, and we may refuse, suspend or close any account at our discretion.
4. Buying
A listing is an offer by the seller to sell the specific part shown, at the listed price plus the listed shipping charge, to a buyer in the continental United States. Placing an order and completing payment forms a contract between you and the seller for that part. Each part is unique and is sold in a quantity of one; while you check out, the part is briefly reserved for you and is yours when payment is confirmed. If payment cannot be confirmed, the reservation ends and the part returns to sale.
Best Offers are invitations to negotiate. A sale occurs only when you complete checkout at the accepted price within the time allowed. Prices are in US dollars. Obvious pricing errors may be corrected and the affected order cancelled and refunded in full.
You are responsible for confirming that a part fits your vehicle before buying, by matching the part number or by asking the seller with your VIN. Fitment information on a listing is provided by the seller in good faith and is not a guarantee of fit.
5. Payment processing and holding
All payments for orders are made to e-airbags.com, which collects them on the seller's behalf as the seller's limited payment collection agent, through Stripe and PayPal. Payment to e-airbags.com satisfies your payment obligation to the seller for that order. We hold the payment until 48 hours after delivery is confirmed (by carrier scan, by you, or automatically 21 days after shipment), and longer while a case is open, and then release it to the seller less our fee. Paying a seller outside the Marketplace for a part listed on it is prohibited and is not covered by buyer protection.
We may collect and remit sales tax on orders as a marketplace facilitator where the law requires. Tax is shown at checkout and is in addition to the item price and shipping.
6. Shipping and delivery
The seller ships every order by ground carrier with a tracking number, within the handling time shown on the listing, to street addresses in the continental United States only. Ground shipping to the continental United States only — no Alaska, Hawaii, territories, APO/FPO or PO boxes. Airbag modules, inflators and pyrotechnic pretensioners are regulated hazardous materials (UN3268, Class 9) and are shipped in compliance with carrier and federal rules by the seller, who is solely responsible for that compliance. Risk of loss passes to you on delivery, subject to Section 7. Our shipping rules describe ship-by dates, late-shipment cancellation and delivery confirmation.
7. Buyer protection and cases
If a part is not received, is not as described in its listing, is the wrong part, or arrives damaged, you may open a case from your order until 48 hours after delivery is confirmed. Opening a case holds the seller's payout. The seller may resolve the case with you; otherwise e-airbags.com reviews the evidence from both sides and decides whether to refund you in full, in part, or release the payment to the seller, and whether the part must be returned. You and the seller agree that our decision about the funds we hold is final between you, without prejudice to any rights you may have against each other under applicable law. Refunds are made to the original payment method. Our buyer protection page explains what is and is not covered; buyer protection is a service of the Marketplace and not a warranty on any part.
8. Fees and taxes
Buyers pay no fees to e-airbags.com beyond the price, shipping and tax shown at checkout. Sellers pay the fees set out in the Seller Agreement and on the fees page. Each party is responsible for its own taxes other than the sales tax we collect as a marketplace facilitator.
9. Prohibited items and conduct
Only used original-equipment parts removed from a documented donor vehicle, and mail-in SRS services from verified shops, may be listed. Aftermarket, replica, counterfeit, deployed, rebuilt and recalled airbags and inflators, and the other items in the Prohibited Items Policy, may not be listed or sold. You may not use the Marketplace to arrange sales outside it, to contact other users for purposes unrelated to a listing or order, to scrape or harvest data, to interfere with its operation, to misrepresent your identity or business, or to break any law. We may remove content and listings and suspend or close accounts that violate these Terms.
10. Safety devices
Airbags, pretensioners, SRS modules and related components are life-safety devices. They must be handled, stored, shipped and installed by qualified persons in accordance with the vehicle manufacturer's procedures and applicable law. e-airbags.com does not inspect, test or certify any part and makes no statement about whether a part will deploy correctly, fits a particular vehicle or complies with any standard. You accept these risks when you buy a used safety device, and you are responsible for having it installed by a qualified technician.
11. Content and intellectual property
Sellers own the photos and text they post and grant e-airbags.com a worldwide, royalty-free license to display, reproduce and adapt that content to operate and promote the Marketplace, including after the listing ends. You are responsible for the content you post and must have the right to post it. The e-airbags.com name, logos and the design of the Marketplace are our property; OEM part numbers, vehicle makes and model names appear on the Marketplace for identification only and belong to their owners. We may remove any content at our discretion.
12. Messaging
Messages between buyers and sellers are sent through the Marketplace, are stored by us and may be read by our staff to resolve cases, enforce these Terms and prevent fraud. Do not share payment details or arrange off-Marketplace transactions through messaging. Messaging is for questions about listings and orders only.
13. Disclaimers
THE MARKETPLACE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, E-AIRBAGS.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ABOUT THE PARTS, LISTINGS, SELLERS OR BUYERS ON THE MARKETPLACE. ANY WARRANTY ON A PART, IF ANY, IS GIVEN BY THE SELLER ALONE. We do not guarantee that the Marketplace will be uninterrupted or error-free.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, E-AIRBAGS.COM AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LABOR, TOWING, RENTAL, DIAGNOSTIC OR INSTALLATION COSTS, PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM A PART SOLD BY A SELLER, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE MARKETPLACE WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID TO E-AIRBAGS.COM IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS (US$100). Some jurisdictions do not allow certain limitations; in those, our liability is limited to the extent permitted.
15. Indemnification
You will defend, indemnify and hold harmless e-airbags.com and its owners, officers, employees and agents from any claim, loss or expense (including reasonable attorneys' fees) arising from your use of the Marketplace, your content, your breach of these Terms, any part you sell or buy, or your violation of any law or third-party right.
16. Disputes and governing law
These Terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules. Any dispute between you and e-airbags.com that cannot be resolved informally will be brought in the state or federal courts located in [County, State], and you consent to their jurisdiction. [Arbitration and class-action waiver — counsel to confirm whether to include] Disputes between buyers and sellers about a part are between them, subject to Section 7 for the funds we hold.
17. Changes, suspension and termination
We may change these Terms by posting the revised version with a new version number and date; material changes are announced on the Marketplace or by email. Continued use after a change is acceptance. We may suspend or close accounts, remove listings and refuse service at any time, including for violation of these Terms or the law, and may hold funds while a case, chargeback or investigation is open. You may close your account at any time; obligations from completed orders survive.
